Terms of Service
Version 1.0 | Draft for launch
Welcome to Niuzie, an online classifieds marketplace operated by Niuzie Solutions, a business name registered in Kenya. By creating an account or using the marketplace, you agree to these Terms of Service.
1. About Niuzie
Niuzie connects independent buyers and sellers. Users may advertise goods, discover listings and communicate through the platform.
Niuzie does not ordinarily own the goods advertised, act as the seller of those goods, collect purchase payments between buyers and sellers, provide escrow, or arrange delivery.
Buyers and sellers are responsible for agreeing on prices, payment arrangements, collection or delivery, and the condition of goods.
2. Eligibility and Accounts
Users must be at least 18 years old to register. Users must provide accurate account information, protect their login credentials and avoid impersonating other people.
You are responsible for activities conducted through your account, except where responsibility arises from Niuzie's own acts or omissions.
3. Seller Responsibilities
Sellers must have the right to sell the advertised goods and must provide accurate descriptions, prices, photographs and information about defects.
Sellers must not publish misleading advertisements, duplicate fraudulent listings or prohibited goods. Niuzie may review, reject or remove listings that breach its policies.
4. Listing Fees and Duration
Niuzie may charge a fee to publish an advertisement. The applicable fee, including any promotional discount or free-listing entitlement, will be displayed before the seller initiates payment.
Paid listings are ordinarily published for 90 days, unless a different duration is expressly stated. Listing fees are payments for advertising services, not payments for the goods advertised.
Niuzie currently uses Tiny Pesa to facilitate eligible listing-fee payments. Payment availability and processing may depend on third-party services.
5. Refund Policy
All listing fees paid to Niuzie Solutions are non-refundable once a listing has been successfully published, regardless of whether the item sells, is withdrawn or remains unsold.
Where payment is received but a listing is not activated because of a technical error, Niuzie will first attempt to activate the listing without requiring another payment.
Refunds or other remedies will be provided where required by applicable Kenyan law.
6. Prohibited Items and Conduct
Users must comply with Niuzie's Prohibited Items Policy and applicable Kenyan law.
Prohibited listings include stolen or counterfeit goods, firearms and ammunition, illegal drugs, prescription medicines, hazardous materials, unlawful wildlife products, explicit adult content, alcoholic beverages and tobacco products.
Fraud, harassment, impersonation, misleading advertisements and attempts to exploit other users are also prohibited.
7. Buyer and Seller Transactions
Buyers should inspect goods, verify seller information and use appropriate caution before making payments. Sellers should accurately disclose the condition and ownership of their goods.
Niuzie does not guarantee that a listing is genuine, that an item will sell, or that a buyer or seller will complete a transaction.
Disputes concerning goods purchased directly from independent sellers should ordinarily be raised with the relevant seller first. Users may report suspected fraud or misconduct to Niuzie.
8. Listing Removal and Account Restrictions
Niuzie may remove advertisements, restrict marketplace features or suspend accounts where reasonably necessary to address suspected fraud, safety risks, unlawful conduct or violations of these terms.
Where appropriate, Niuzie may request additional information before taking or reversing an action.
9. Personal Information
Niuzie processes personal information as described in its Privacy Policy and in accordance with applicable data protection requirements.
10. Service Availability and Liability
Niuzie aims to provide a reliable marketplace but cannot guarantee uninterrupted availability or error-free operation.
To the extent permitted by applicable law, Niuzie is not responsible for losses arising solely from independent transactions between buyers and sellers. Nothing in these terms excludes rights, remedies or liabilities that cannot lawfully be excluded.
11. Changes to These Terms
Niuzie may update these terms to reflect operational, legal or service changes. Material updates may require users to review and accept a new version before continuing to use relevant marketplace features.
12. Governing Law
These terms are governed by the laws of Kenya, subject to applicable mandatory consumer protection and other legal rights.
13. Contact
